Joss is a specialist chancery barrister with particular expertise in wills, trusts and probate disputes, professional negligence and Court of Protection claims. He is ranked as a leading junior across these areas, both in the Legal 500 and Chambers UK.

His trusts, estates and probate practice deals with all aspects of contentious practice including:

  • Contentious probate/will validity disputes, including assertions of undue influence, want of knowledge and approval and lack of capacity. Joss recently appeared for the successful claimants in Oliver v Oliver [2024] EWHC 2289 (Ch).
  • Claims for provision under the Inheritance (Provision for Family and Dependants) Act 1975, including for the claimants in Larsen v Annan [2023] EWHC 662 (Ch).
  • The rectification and interpretation of wills. He acted for the defendants in Bracey v Curley [2022] EWHC 359 (Ch).
  • Applications to remove executors and administrators under section 50 of the Administration of Justice Act 1985.
  • Professional negligence claims against solicitors, will drafters and professional executors.
  • Proprietary estoppel claims. Joss acted for the defendant in Culliford v Thorpe [2018] EWHC 426 (Ch) who successfully established an interest in property against the estate of his late partner.

Joss’s has an extensive professional negligence practice acting primarily against legal professionals.

His solicitors’ negligence caseload often links with his chancery/real estate practice, including claims concerning the negligent drafting of wills, the maladministration of estates and negligence in conveyancing and litigation.

Recently, Joss acted for the defendant in Bracey v Curley [2022] in which the court considered the alleged negligence of the will draftsman and the potential for a non-party costs order against the solicitors following an order for rectification.

Joss has a growing Court of Protection Practice, acting primarily in property and affairs matters. He is regularly instructed in disputes relating the validity of Lasting Powers of Attorney, statutory wills claims and deputyship applications.

Recently, he represented the successful applicants in Re K (2022) who sought and obtained orders removing the respondent from his position as attorney for health and welfare and property and affairs and appointing them as deputies in his place.

Trusts and Estates Litigation

Joss is a wills and trusts specialist, ranked as a leading junior in Chambers & Partners and the Legal 500. He has particular expertise in probate claims, claims under the Inheritance (Provision for Family and Dependants) Act 1975, disputes concerning the construction and rectification of wills, and claims for an interest in property on the basis of proprietary estoppel, resulting trust or constructive trust.

Joss also advises on all matters relating to the estate administration, and has particular experience in applications for the removal of executors under s.50 of the Administration of Justice Act 1985, and the administration of insolvent estates.

He regularly acts in claims where the validity of a will is disputed on the grounds of lack of capacity, undue influence or want of knowledge and approval, recently appearing for the successful claimant in Oliver v Oliver [2024] EWHC 2289 (Ch).

His reported cases include:

  • Tucker v Felton-Page & Ors [2025] EWHC 530 (Ch) – acted for the executors in a successful contentious probate claim before HHJ Berkley.
  • Oliver & Ors v Oliver [2024] EWHC 2289 (Ch) – trial before HHJ Matthews. Represented the successful claimants in overturned the last will of their late father on the grounds he lacked testamentary capacity and further, was the subject of undue influence.
  • Larsen & Annan v Annan [2023] EWHC 662 (Ch) – Claim under the Inheritance (Provision for Family and Dependants) Act 1975 in the High Court in Cardiff before Zacaroli J. Represented the claimants, who were children of the deceased in a claim which was partially successful.
  • Bracey v Curley [2022] EWHC 359 (Ch) – Trial for a determination of the true construction of a will, alternatively rectification. Represented the defendants in a claim where rectification was granted, with consideration also given to whether to make a third-party costs order against the will-drafting solicitors.
  • Culliford v Thorpe [2018] EWHC 426 (Ch) – Represented the defendant, who successfully established an interest in his late partner’s property on the basis of a common intention constructive trust and proprietary estoppel.
Court of Protection

Joss has a burgeoning Court of Protection practice specialising in contentious matters relating to property and affairs and is ranked as a leading junior in the Legal 500.

He regularly appears in contested deputyship applications, statutory wills claims and applications to revoke lasting powers of attorney.

In 2023 he appeared in Re K (2023), a four-day trial before HHJ Sullivan in which he represented the applicants who sought and obtained a revocation of lasting powers of attorney for property and affairs and health and welfare on the grounds of lack of capacity and undue pressure exerted by the attorney, as well as their own appointment as deputies. Instructed by Freeths.

Other recent cases include:

  • Re S (2025)Long-running dispute concerning the validity of various LPAs and revocations. Instructed by Michelmores.
  • Re F (2024) – wide-ranging application where P had farming assets worth in excess of £10m. Directions sought in relation to care, limiting contact and declarations revoking lasting powers of attorney. Instructed by Wolferstans.
  • Re W (2024) – acted for the respondent in an application which concerned the restriction of contact between a father and his adult son, P in circumstances where the father was the subject of a police investigation. Instructed by Stephens Scown.
Professional Negligence

Joss is an experienced professional negligence barrister, acting on behalf of claimants, defendants and insurers in claims against solicitors, architects and construction professionals. He is ranked as a leading junior in Chambers UK and the Legal 500.

His solicitors’ negligence caseload often links with his chancery/real estate practice, including claims concerning the negligent drafting of wills, claims surrounding the maladministration of estates and negligence in conveyancing.

In 2022 he appeared in Bracey v Curley [2022] EWHC 359 (Ch) in which the court considered the construction of a will, the alleged negligence of the will draftsman and the potential for a non-party costs order against the solicitors following a declaration for rectification.

Other recent cases include:

  • T v FP (2024)alleged negligence arising out of the drafting of a share purchase agreement for the sale of a components company. Joss acted for the defendant solicitors.
  • CSTGCL v BJDW (2021) – successfully represented the claimant company in a three-day trial before HHJ Ambrose against both its former solicitors and accountants concerning negligent tax advice following the sale of a golf club.

Early on in his career, Joss spent time on secondment at RPC LLP dealing exclusively with claims against construction professionals, including architects, surveyors, valuers and approved inspectors.

More recently he has acted for a number of claimants in claims involving Buyer-Led Development Schemes – principally against their former solicitors.

Real Property

Joss acts in a wide variety of property matters with a particular focus on TOLATA claims, partnership disputes, easements and the intersection between real estate and professional negligence.

He recently appeared for the defendants in Carter v Goldsworthy (2023) instructed by Foot Anstey LLP where he was successful at first instance (decision of HHJ Carr) and on appeal (Collins Rice J) in a long-running and complex dispute concerning allegations of interference with an express easement, nuisance and trespass.

Joss’s expertise in professional negligence means he is often instructed in property matters involving negligence and has significant expertise in conveyancing negligence and claims for misrepresentation.

Other recent cases include:

  • Belford v Parry (2023) – Joss represented the defendant in a four-day trial before HHJ Salmon in a dispute concerning allegations of nuisance, trespass, equitable easements and inference with rights of way.
  • S v C (2023) – property misrepresentation claim arising out of the sale of a property formerly owned by a premiership footballer.
  • P v R (2024) – dispute concerning the enforceability of historic express easements in the First-Tier Tribunal before
  • Culliford v Thorpe [2018] EWHC 426 (Ch) – Trial before HHJ Matthews. Represented the defendant, who successfully resisted an order for possession and obtained a declaration that he had a beneficial interest in the property, acquired on the basis of common intention constructive trust and/or proprietary estoppel.
