Sarah Haren KC successful in upholding disputed Deed of Variation: Canarapen v Gauchenot [2025] EWHC 2728 (Ch)

Judgment has been handed down for the claimant in this dispute about a deed of variation. Its effect and validity were challenged by the defendant who made it.  Sarah Haren KC acted for the successful claimant, instructed by Myerson Solicitors.  The defendant had signed the deed to vary her share of her mother’s estate in favour of her nephew, the claimant.  However she subsequently denied that it was binding on her arguing either that it had not been delivered or that she had been mistaken when signing it.   The validity of the deed was upheld following a three-day trial before Master Pester.   A link to the judgment, which discusses what it means to “deliver” a deed and the nature of a mistake sufficient to justify setting aside a gift is here.
