The case considered the principles which apply when determining the beneficial shares of an unmarried couple in the family home, following the House of Lords’ decision in Stack v Dowden [2007] UKHL 17 and the Supreme Court’s decision in Jones v Kernott [2011] UKSC 53. The Court of Appeal also examined the circumstances in which the burden of a mortgage may be thrown on the share of one co-owner, by virtue of an “equity of exoneration”.
