Sarah Haren appeared for the successful respondent in the Court of Appeal in Graham-York v (1) York (2) Leeds Building Society [2015] EWCA Civ 72

The case considered the principles which apply when determining the beneficial shares of an unmarried couple in the family home, following the House of Lords’ decision in Stack v Dowden [2007] UKHL 17 and the Supreme Court’s decision in Jones v Kernott [2011] UKSC 53. The Court of Appeal also examined the circumstances in which the burden of a mortgage may be thrown on the share of one co-owner, by virtue of an “equity of exoneration”.
