Penelope Reed KC and Elis Gomer successful in proprietary estoppel claim

Penelope Reed KC and Elis Gomer acted for the successful Claimant, Gareth Hughes, in the proprietary estoppel claim in Hughes v Pritchard and ors [2023] EWHC 1382 (Ch).  The case had been remitted to the High Court for the determination of the Defendants’ proprietary estoppel counterclaim after the successful appeal by the Claimant to the Court of Appeal on the issue of testamentary capacity (see Hughes v Pritchard and ors [2022] EWCA Civ 386), in which Penelope and Elis also appeared.

HHJ Keyser KC (sitting as a Judge of the High Court) dismissed the counterclaim, finding that no detriment had been suffered and that no equity or remedy arose.  The judgment is believed to be the first judgment by the High Court on a proprietary estoppel claim since Guest v Guest [2022] UKSC 27, in which Penelope represented the successful Respondent.
