Members of chambers in Court of Protection in Hinduja v Hinduja [2026] EWCOP 34 (T3)
Mark Baxter, leading Sam Chandler, and Sarah Haren KC, leading Georgia Bedworth of 10 Old Square, recently appeared in this application for permission to use documents from the Court of Protection proceedings concerning the late SP Hinduja for the purposes of other litigation. Mark and Sam acted for Sanjay Hinduja, SP’s nephew, instructed by Withers LLP. Sarah acted for Vinoo and Shanu Hinduja, SP’s daughters, instructed by Harbottle & Lewis LLP.
This is one of the few published decisions about applications to use documents filed in Court of Protection proceedings for other purposes. In her judgment Mrs Justice Bacon held that the Court of Protection should take a staged approach to giving permission for use of documents in other proceedings and should use similar principles to those which apply under the Civil Procedure Rules 1998.
