Cator & Ors v Thynn & Anor [2026] EWHC 1045 (Ch) (07 May 2026)
Henry Legge KC on behalf of the Longleat trustees led this application to include Lord and Lady Bath’s son – who was carried to term by surrogate mother in the US – as a beneficiary of these substantial settlements.
The judge also accepted the trustees’ application for the representation to be governed by an issue based representation order. This appears to be the first time that this approach has been adopted in the English courts in this type of private trust application.
