“P’s Deputy or Attorney is often someone closely associated with them, even with entwined financial interests – this gives rise to potential conflicts of interest, not least the possibility of applying P’s assets in a way that benefits the Deputy or Attorney. The Court of Protection has considered this question in several cases and not always reached the same conclusion: so is it possible to divine the applicable principles? Further, if P’s assets have been applied improperly, how can they be recovered?
